It is called apology because it is a way of defending oneself, and making them understand that he was not guilty. In the apology, Socrates is defending himself in the case raised against him. Hence, he is not apologizing, but rather giving out a speech in his defense.

Undoubtedly, Socrates did not fear death because he believes it was a state of unconsciousness and nothingness. Socrates believed that division of both soul and body existed; it implied that individual is a soul while the body is the house. Hence, Socrates was assured that death would not harm him in anyway. His body would not exist anymore, but the soul will relocate to a different place. In his entire life, he was loyal to God and family; therefore, his death will not be a loss to the family. What was important for him was to seek the truth.
